European & Public Law
Many of Ross & Co’s clients are international. Their businesses are often cross-border, situated across a range of EU member-states. Because of this, Ross & Co has developed considerable expertise in European Law.
We have experience of litigating EU legal issues in the European courts (and especially the European Court of Justice) and also at the national level, including the English High Court and Court of Appeal, and also in the Competition Appeal Tribunal.
We have litigated for clients in a variety of substantive EU law areas including transport and shipping law, freedom of establishment, free movement of workers, industrial manufacturing and telecommunications.
In response to client demand, our expertise in European Law is now complemented by our work in Public and Administrative Law where we specialise in judicial review proceedings and especially those with a European aspect where our client ultimately seeks a reference to the ECJ.
Examples of recent work include:
- (1) International Transport Workers' Federation (2) Finnish Seamen's Union v (1) Viking Line ABP (2) Ou Viking Line Eesti [2005] EWCA Civ 1299 / C-438/05 (click here for ECJ judgment).
- R (Telefónica O2 Europe plc & Others) v S/S BERR CO/8322/07 / C-58/08 (click here for Administrative Court reference judgment).
- Emerson Electric Co and others v Morgan Crucible Company plc and others Case No: 1077/5/7/07 (click here for recent CAT judgment).
